Terms of Service

These Terms of Service ("Terms") govern your use of Storify Builder's website and services. By engaging our services or using our website, you agree to be bound by these Terms.

1. Services Provided

Storify Builder offers professional web development services including but not limited to:

• Custom website design and development
• E-commerce store setup and integration
• Landing page design and optimization
• Website redesign and modernization
• Search engine optimization (SEO)
• Ongoing maintenance and technical support

The specific scope, deliverables, and timeline for each engagement are defined in a written proposal or statement of work that both parties must agree to before work begins.

2. Payment Terms

All payments are processed securely through Stripe. We accept Visa, Mastercard, American Express, and Discover.

• A 50% deposit is required before we begin any project work.
• The remaining 50% balance is due upon project completion and prior to the transfer of final files or website launch.
• Retainer and maintenance plans are billed monthly in advance.
• Prices are quoted in US Dollars (USD) and do not include applicable sales or use taxes, which will be added where required.
• Late payments may accrue interest at 1.5% per month (or the maximum permitted by law, whichever is lower).

3. Refund & Cancellation Policy

Refund terms are described in full in our Refund Policy. In summary:

• The 50% deposit is non-refundable once work has begun.
• A full refund is available if the project has not started within 7 days of payment.
• Once final files are delivered, the project is considered complete and no refunds will be issued.

4. Client Responsibilities

You agree to:

• Provide accurate, timely information and content (text, images, brand assets) necessary to complete the project.
• Review and respond to communications and deliverables promptly to avoid delays.
• Ensure you have the legal right to use any materials you supply.
• Complete payment obligations on time.

Excessive delays in providing feedback or content may extend timelines and, in extreme cases, be treated as project abandonment.

5. Intellectual Property

Upon full payment, you will own all custom design and content deliverables produced specifically for your project. Storify Builder retains rights to:

• Any general knowledge, methodologies, code libraries, and tools used across engagements.
• Third-party components and open-source software, which remain subject to their original licenses.
• The right to display non-confidential portions of your project in our portfolio unless otherwise agreed in writing.

6. Revisions & Scope Changes

Each plan includes a specified number of revision rounds. Additional revisions, feature additions, or scope changes will be quoted separately and require your written approval before work continues.

7. Warranties & Post-Launch Support

We warrant that our work will be free from material defects for the post-launch support period included in your plan (30, 60, or 90 days depending on tier). During this period we will fix bugs in our original work at no charge. This warranty does not cover:

• Changes made by you or third parties after delivery.
• Issues caused by third-party plugins, hosting, or services.
• New features or design changes.

8. Limitation of Liability

To the maximum extent permitted by law, Storify Builder is not liable for indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total aggregate liability for any claim shall not exceed the amount you paid us for the specific engagement giving rise to the claim.

We are not responsible for downtime, data loss, or business interruption caused by third-party services (hosting providers, payment processors, DNS providers, etc.).

9. Confidentiality

Both parties agree to keep confidential any non-public business information shared during an engagement and to use it solely for the purpose of the project.

10. Termination

Either party may terminate an engagement in writing with reasonable notice. Upon termination, you agree to pay for all work completed up to the termination date. Deposits already paid are subject to our Refund Policy.

11. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Madison County, Kentucky, and both parties consent to the exclusive jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
